LandscapeBase is a software service provided by ALPHARD GLOBAL LIMITED, company number 16519400, registered office Flat 71 Warehouse Court, No 1 Street, London SE18 6FB ("we", "us", "our").
These terms govern your use of the LandscapeBase website at landscapebase.co.uk and the LandscapeBase application (together, the "Service"). By creating an account or using the Service you agree to them. If you are agreeing on behalf of a business, you confirm you have authority to bind that business, and "you" means that business.
If you do not agree to these terms, do not use the Service.
Our Privacy Policy explains how we handle personal data and forms part of these terms.
What LandscapeBase does
LandscapeBase is business software for landscaping and garden design firms. It helps you capture and manage enquiries, keep customer and project records, produce costings and quotations, schedule appointments, track project delivery, and draft replies to customers.
We may add, change or remove features over time. We will not materially reduce the core functionality you are paying for without giving you reasonable notice.
Your account
You must give accurate registration details and keep them up to date. You are responsible for all activity under your account, including by the staff and contractors you allow to use it, and for keeping login credentials secure. Tell us promptly at hello@landscapebase.co.uk if you believe your account has been compromised.
You must be at least 18 and use the Service for business purposes. The Service is not intended for consumers.
Connecting third-party accounts
The Service lets you connect accounts you hold with third parties, for example Google (Gmail and Google Calendar), Microsoft, WhatsApp, Xero and Wix.
When you connect an account you authorise us to access it on your behalf, limited to the permissions shown to you at the point of connection. You confirm you are entitled to grant that access.
Our handling of data obtained from Google APIs, including Gmail and Google Calendar, is described in our Privacy Policy. LandscapeBase's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
You can disconnect a third-party account at any time in Settings → Integrations, or revoke our access from within that provider's own account settings. Connected services are operated by those third parties under their own terms, and we are not responsible for their availability or their acts.
Email sent through the Service
Where you connect an email account, the Service can draft messages and, where you instruct it, send them from your address.
Drafts are written to your mailbox for your review. We will not send a message to a customer without an instruction from you.
You are the sender of any message sent through the Service. You are responsible for its content and for complying with applicable law, including UK GDPR, the Privacy and Electronic Communications Regulations and any other anti-spam rules that apply to you.
You must not use the Service to send unsolicited bulk email, or to contact people who have asked you not to contact them.
Artificial intelligence features
Parts of the Service use AI models to extract information from enquiries, produce documents and suggest draft replies.
AI output can be wrong, incomplete or unsuitable. You must review AI-generated content before you rely on it or send it to a customer. Quotations, prices, measurements and commitments produced or suggested by the Service are working figures, not advice, and are not binding on us. You are solely responsible for what you send and for any contract you enter into with your customers.
We do not use your Google user data to develop, improve or train generalised or non-personalised AI or machine learning models. See the Privacy Policy for detail.
Your data
You keep all rights in the data you put into the Service and the data we access on your behalf from connected accounts ("Your Data").
You grant us a limited licence to host, process and transmit Your Data solely to provide the Service to you, keep it secure, and provide support where you ask for it.
You are the data controller for personal data about your own customers and contacts. We act as your processor for that data: we process it only on your instructions, keep it confidential, apply appropriate security measures, and assist you with data subject requests. Our full data handling practices are set out in the Privacy Policy.
You can export Your Data at any time while your account is active, and for 30 days after it closes. On request, or 30 days after account closure, we delete Your Data, except where we are required to retain it by law.
Acceptable use
You must not:
- Break the law, infringe anyone's rights, or use the Service to harass or defraud anyone
- Upload malware, or attempt to gain unauthorised access to the Service or to other customers' data
- Probe, scan or load-test the Service without our written permission
- Reverse engineer, decompile or copy the Service, except where that right cannot be excluded by law
- Resell, sublicense or provide the Service to a third party as a bureau service, unless we have agreed in writing
- Use the Service to access an email account you are not authorised to access
- Use automated means to extract data from the Service beyond the interfaces we provide
We may suspend an account immediately where we reasonably believe this section has been breached, or where continued use poses a security or legal risk. We will tell you why, and we will restore access once the issue is resolved.
Fees
Fees are as set out on our pricing page or in your order. Unless your order says otherwise, we bill monthly in advance, there is no minimum term or annual contract, and fees are exclusive of VAT where applicable.
Fees for a billing period that has already started are not refundable, except where we have expressly promised a refund, for example under a guarantee published on our pricing page or agreed in your order.
We may change our prices on 30 days' written notice. If you do not accept a price change, you may cancel before it takes effect.
If a payment fails we may suspend access after giving you reasonable notice.
Availability and support
We aim to keep the Service available and to fix faults promptly, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, and will try to schedule anything disruptive outside UK working hours.
Support is provided by email at hello@landscapebase.co.uk and through any other channels we make available to you. Response times we publish are targets, not guarantees, unless agreed in writing.
Our intellectual property
We own the Service, including its software, design and documentation. Nothing in these terms transfers that ownership to you. We grant you a non-exclusive, non-transferable right to use the Service during your subscription, for your own business purposes.
If you give us feedback, we may use it freely without obligation to you.
Warranties and liability
The Service is provided with reasonable skill and care. Beyond that, and to the extent the law allows, we exclude all implied warranties, including fitness for a particular purpose.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, and to the extent the law allows:
- Neither party is liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill, or loss of anticipated savings.
- Our total liability to you in any twelve-month period is limited to the fees you paid us in the twelve months before the claim arose.
We are not liable for loss arising from your reliance on AI-generated content that you did not review, or from the acts, outages or decisions of third-party services you have connected.
Ending your subscription
You can cancel at any time in your account settings or by emailing us. Cancellation takes effect at the end of your current billing period.
We may terminate these terms on 30 days' notice, or immediately if you materially breach them and do not fix the breach within 14 days of being asked to.
On termination your right to use the Service ends. You can export Your Data as described in section 07, and we then delete it.
Changes to these terms
We may update these terms. If a change materially affects your rights we will give you at least 30 days' notice by email or in the Service. Continuing to use the Service after a change takes effect means you accept it. The date at the top of this page shows when the terms were last updated.
General
These terms are the whole agreement between us on this subject. If any part is found unenforceable, the rest still applies. A delay in enforcing a right is not a waiver of it. You may not assign these terms without our consent; we may assign them to a group company or to a buyer of our business.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
